Probate Lawyer Surrey
At Westcoast Wills & Estates, our experienced probate lawyers in Surrey are here to ease the burden that often falls on executors (when there’s a will) and estate administrators (when there isn’t). Taking on the role of executor can feel overwhelming, especially since executors and administrators are personally liable for any errors they make during the estate administration process. Our Surrey team is committed to making probate as stress-free as possible by offering step-by-step legal guidance and support tailored to your needs.
The Supreme Court of BC offers different types of estate grants, the most common being the Grant of Probate (when a will exists) and the Grant of Administration Without Will Annexed (when there is no will). While the terminology differs, both give the applicant legal authority to manage the estate. Our estate lawyers in Surrey have years of experience successfully obtaining these grants.
When you book an appointment with a probate lawyer at our Surrey office, we begin with a comprehensive consultation meeting to review your situation and outline the necessary steps involved in estate administration. It’s important to understand that applying for probate is just one part of the broader process of estate administration. From that point forward, our Surrey probate lawyer can assist as much—or as little—as you need, whether it’s with the application itself or with managing the estate through to final distribution.
Estate Administration Lawyer Surrey
Even if a probate application isn’t required, many responsibilities still fall on the executor or administrator. Our probate lawyers in Surrey can help with tasks such as contacting financial institutions, communicating with beneficiaries, or preparing releases for beneficiaries to approve the executor’s accounting. We aim to ensure nothing is overlooked and that your duties are fulfilled accurately and efficiently.

Probate Law FAQs
Here are some of the most common questions that our lawyers routinely hear.
Probate means to “prove.” In the case of wills, it refers to the process of proving to the court that a will is legally valid as the last will and disclosing all of the assets in the estate. Oftentimes people loosely use the word “probate” to refer to the much broader process of estate administration though – only a part of which is applying for probate from the court. Estate administration ranges from arranging the funeral, preparing the probate application, filing taxes, paying other debts, distributing the estate, and dozens of steps in between.
Probate is handled by the Supreme Court of BC. The Vancouver Probate Registry currently has a roughly two month delay between the time an application is received and the time that they approve the application. In recent years, that delay has been as much as six months and as short as two weeks. Other court registries have different delay times, but dealing with a registry out of town has its own challenges. See here for a map of the different Supreme Court probate registries throughout the province: https://www.courts.gov.bc.ca/supreme_court/court_locations_and_contacts.aspx
Simply speaking, the probate fee is a tax charged by the court to approve a will, or in the case of an intestate’s estate, approve the administrator of the estate. In BC, the fee is currently roughly 1.4% of all the assets passing through the estate. We have a probate fee calculator here to help you approximate what the probate fee will be.
